The Trump administration’s interpretation of the Immigration and Nationality Act conflicts with historical practice and Congress’ intent, the appellate panel found in a 2-1 decision.

A divided 9th U.S. Circuit Court of Appeals panel has rejected the Trump administration’s mandatory detention policy for undocumented immigrants.
