FBI Investigators work on the scene near the 10000 block of Main Street in Portland where two people were shot and wounded Thursday, Jan. 8, 2026, by U.S. Border Patrol earlier that day.

The two people shot in Portland last week by U.S. Border Patrol face criminal charges. Both have been released from hospital and into federal custody.

The U.S. Department of Justice charged Luis David Nino-Moncada with aggravated assault on a federal officer with a deadly or dangerous weapon and depredation of federal property.

He’s set to appear in federal court on Monday. His attorney declined to comment.

Six U.S. Border Patrol agents were present during the shooting at a hospital parking lot in East Portland on Thursday afternoon, according to the federal charging document.

There is no video of the shooting and the circumstances that led up to it.

“There is no body worn camera footage from the involved six Border Patrol Agents capturing the above-described events. Investigators have scoured the area and social media in an effort to find surveillance footage, but to no avail,” FBI Special Agent Daniel Jeffreys wrote in the complaint. “The fixed surveillance cameras in the area of this parking lot, according to the business, did not capture footage of this event.”

Jeffreys stated that investigators are continuing to search for video, but so far have been unsuccessful.

Yorlenys Betzabeth Zambrano-Contreras is charged in Texas with illegal entry into the United States. She is being held at Northwest ICE Processing Center in Tacoma, Washington, according to facility records.
