The three judges who heard Alex Gerkin's appeal said they all could not understand the Miranda warning a Washington County sheriff's deputy gave to a motorcyclist after reviewing the officer's body camera video. On far right, Judge Kristina Hellman started off, asking the state attorney defending it: “Have you watched the video?”

The lawyer for the state had just stepped to the lectern before the Oregon Court of Appeals and identified himself.
